Marich Music Rental Agreement
Please read before completing your reservation.
By submitting your rental order, You agree to the terms below. This agreement outlines how our rental program works, including ownership options, payment terms, maintenance coverage, and return procedures.
Parties to This Agreement
This agreement is between:
- You, the customer completing this rental reservation (referred to as “You” or “Customer”), and
- Market Street Guitars, LLC, doing business as Marich Music (referred to as “Marich Music,” “We,” or “Us”).
By completing your reservation, You acknowledge that You have read and understood the terms of this agreement.
1. Lease Terms
You are renting a musical instrument from Marich Music under a month-to-month lease agreement.
- The initial lease period is one month.
- This agreement automatically renews at the start of each successive month unless the instrument is returned to Marich Music.
- There is no obligation to continue renting beyond the initial lease period.
- Monthly payments will continue until You either return the instrument or complete the required payments for ownership, as defined in Section 2.
Your payment method will be charged automatically on the same calendar date each month.
2. Ownership Option (Rent-to-Own)
You will own the instrument once You have either (a) completed all required monthly rental payments totaling the published ownership price, or (b) chosen to convert Your rental into an early discounted purchase under the terms of this agreement.
- Each monthly rental payment, including Your first, is applied toward the ownership total.
- The number of payments required to acquire ownership varies by instrument and is equal to the price shown when the instrument is added to Your shopping cart at checkout.
- You will never be charged more than the published ownership price, which may result in the final payment being less than a full monthly charge.
- Sales tax is applied to each monthly payment and is not included in the ownership total.
- Until ownership is transferred, You may not sell, transfer, pledge, encumber, or otherwise dispose of the instrument.
- The ownership price does not include any additional costs such as late fees, reinstatement charges, or other penalties that may accrue under this agreement.
3. Return & Cancel Anytime
You may cancel this agreement at any time by returning the instrument to:

Once the instrument has been inspected upon return and found to be in good condition:
- No further rental payments will be charged.
- Any outstanding rental fees, late charges, or delivery fees accrued prior to return remain Your responsibility.
- You will not receive a refund for any unused portion of a rental period already paid.
Rental fees will continue to accrue until the instrument has been physically returned, inspected, and checked in by Marich Music staff.
4. Early Payoff Discount
You may convert your rental to a purchase at any time during your rental term and receive a 40% discount on the remaining balance, provided that all rental payments are current and the agreement is not in default.
All prior rental payments are still applied toward the full ownership price. Only the remaining balance will be discounted.
To request a payoff amount and finalize the purchase, contact Marich Music directly. Ownership is transferred once payment in full has been received.
5. Switch Instruments (Trade-In Credit)
You may switch to a different rental instrument at any time. This policy applies to instrument switches within Marich Music’s in-stock active rental fleet. It does not apply to instruments sold outright in the store or to special orders.
When switching instruments, up to 12 months of rental payments from your original agreement will be applied as credit toward the new rental. We’ve found that most students commit to an instrument type within this timeframe.
This cap reflects the depreciation of returned instruments over time and helps us keep rental pricing fair across all instrument categories.
If Your accumulated rental payments exceed 12 months, the excess will not be refunded or credited and will be considered fully earned under the original agreement.
If the applied credit exceeds the balance on the new agreement, the excess will not be refunded.
6. Service & Maintenance Coverage
All rental instruments from Marich Music include maintenance and repair coverage for the duration of your rental term.
This coverage includes:
- Repairs due to normal wear and tear
- Accidental damage during regular use
- Priority placement in our in-house repair queue
- Loaner instrument if repairs take longer than 24 hours
Loaner availability is not guaranteed and may be limited during peak repair seasons.
This service remains active as long as your account is current and not in default.
Not Covered:
- Damage due to negligence, abuse, or improper handling
- Cosmetic issues (scratches, dents, lacquer wear, faded finish)
- Routine replacement of expendable accessories, including reeds, mouthpieces, lubricants, drumsticks, bow hair, strings, and drumheads
Only Marich Music is authorized to perform repairs on rental instruments. Outside repairs void this coverage.
If the instrument is lost, stolen, or damaged beyond repair—regardless of fault—You are responsible for the instrument’s fair market value, not to exceed the published ownership price.
You are also responsible for maintaining the instrument in good condition during the rental term, including regular care and replacement of expendable accessory items.
7. Payment Terms
Rental payments are charged automatically each month using the payment method provided at checkout. Your monthly due date is based on the calendar date of your first transaction.
- Charges are processed on that same calendar day each month, including weekends and holidays.
- If a payment is declined or returned, a $10 late fee will apply 10 days after the original due date.
- Future payments will first be applied to any unpaid late fees before being credited toward your rental balance.
You are responsible for ensuring your payment information remains current. Failure to update expired or invalid payment methods may result in late fees, suspension of service coverage, or termination of the agreement.
8. If You're Struggling, Talk to Us First
If you're having trouble keeping up with payments, please contact us. We’ve been there, and we understand how hard things can get. Our goal is never to deny a student the opportunity to learn music because of financial strain.
We’re happy to work with you to find a solution — whether that means adjusting payment timing, temporarily pausing the rental, or exploring other options. Every situation is different, and we’ll always try to help.
Repossession (When We Don’t Hear From You)
If payments fall significantly behind and we’re unable to reach you, Marich Music may initiate repossession of the rental instrument. This would only happen if:
- Your account is seriously past due, and
- We haven’t received a response after multiple outreach attempts.
In these cases, we may recover the instrument from your residence, your child’s school, or another appropriate location. You are still responsible for any unpaid rental fees and late charges that accrue up to the date the instrument is returned.
If legal or recovery costs are incurred, You may be responsible for those fees, to the extent permitted by law.
If your agreement ends but you return the instrument voluntarily, you may reinstate your rental within three (3) months by paying the missed balance and fees.
9. Additional Terms & Acknowledgment
This agreement represents the full understanding between You and Marich Music regarding your instrument rental. It supersedes any prior verbal or written agreements related to this transaction.
- Any modifications must be made in writing and signed by both You and Marich Music.
- If more than one person signs this agreement as “Lessee,” responsibility is shared jointly and individually.
- If any part of this agreement is found to be unenforceable under applicable law, the remaining terms will continue in full effect.
- If You completed a separate credit or payment authorization form, those terms are considered part of this agreement.
By completing your rental reservation, You acknowledge that:
- You have read and understand the terms of this agreement
- You agree to abide by these terms during the course of the rental
- You are entitled to a copy of this agreement for your records
